1. Agreement to Terms
These Terms of Service ("Terms") form a binding agreement between you and Pace ("we," "us," "our") governing your access to and use of the Pace mobile application and related services (the "App"). By creating an account or using the App, you agree to these Terms and our Privacy Policy and Child Safety Standards. If you don't agree, don't use the App.
2. Eligibility
You must be at least 18 years old to create a Pace account. During onboarding we ask for your date of birth, and on supported devices we may also check an OS-provided age range (Apple's Declared Age Range API or Google Play Age Signals). See our Child Safety Standards for details. We may suspend accounts we reasonably believe belong to someone under 18, or that were created to evade a prior ban.
3. Your Account
You're responsible for the accuracy of the information you provide and for all activity under your account. Keep your login credentials secure — notify us immediately at hello@pacesocial.net if you suspect unauthorized access.
You may not impersonate another person, create a fake or duplicate profile, or use another user's account. One account per person — creating multiple accounts to evade a ban or our verification requirements is prohibited.
You are responsible for your own safety. Pace facilitates introductions between users who may not know each other. What happens when you meet in person is between you and the other person — Pace is not present at, and does not supervise, any walk, run, or in-person meeting.
4. In-Person Meetings & Assumption of Risk
The App is designed to help you arrange in-person walks and runs with other users. You acknowledge and agree that:
- Meeting anyone new in person carries inherent risk, and you assume that risk entirely and voluntarily.
- Age eligibility checks confirm that you stated you are 18 or older — they are not a criminal background check or identity verification, and Pace cannot guarantee the identity, intentions, or conduct of any user you're grouped with.
- You are solely responsible for the precautions you take before, during, and after any in-person meeting arranged through the App. See our Safety Guidelines for our specific recommendations.
- Pace is not liable for any injury, loss, or damage arising from an in-person interaction with another user, to the maximum extent permitted by law.
5. User Conduct
When using Pace, you agree not to:
- Harass, threaten, stalk, or abuse another user, on or off the App
- Post or transmit content that is unlawful, obscene, hateful, or discriminatory
- Upload or share content involving the sexual exploitation of minors in any form — this includes zero tolerance for CSAE/CSAM; see our Child Safety Standards
- Use the App for commercial solicitation, advertising, or unauthorized promotion
- Misrepresent your identity, age, or intentions
- Attempt to bypass the 18+ age gate, blocking, or reporting features
- Attempt to access another user's account or Pace's systems without authorization
- Use the App if you have been convicted of a violent or sexual offense
- Interfere with, disrupt, or reverse-engineer the App

6. Content You Share
You retain ownership of any content (profile info, messages) you submit to Pace. Pace does not collect profile photos. By submitting content, you grant Pace a limited, non-exclusive license to use, display, and process that content solely to operate and improve the App. You're responsible for ensuring you have the rights to anything you post.
7. Reporting, Enforcement & Termination
We may investigate, warn, suspend, or permanently terminate any account that violates these Terms or our Safety Guidelines, with or without notice, at our discretion. You may delete your own account at any time — see Delete My Account for instructions.
8. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that grouping will be uninterrupted, error-free, or result in a successful meetup.
9. Limitation of Liability
To the maximum extent permitted by law, Pace and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to use) the App, or from any interaction or in-person meeting with another user.
10. Indemnification
You agree to indemnify and hold Pace harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your interactions with other users, including in-person meetings.
11. Governing Law & Disputes
These Terms are governed by the laws of the state in which Pace is incorporated, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App will first be attempted to be resolved informally by contacting hello@pacesocial.net.
12. Changes to These Terms
We may update these Terms from time to time. We'll update the "Last Updated" date above, and for material changes, we'll provide notice in the App or by email before they take effect.
